Die einen mgen dazu sagen, dass die Methode' die richtige Antwort auf den stetigen und immer grer werdenden Anfall von kleinerer und mittlerer Kriminalitt sei.2 So hat Kunz schon 1984 angemerkt: 'Das auf den typischen Fall schwerwiegender Kriminalitt zugeschnittene Strafverfahren ist fr Massendelikte zu schwerfllig und zu aufwndig; Staatsanwaltschaften und Strafgerichte leiden unter einer chronischen BagatellfallVerstopfung', die ihnen die Kraft nimmt fr die Bekmpfung gravierender sozialschdlicher Verhaltensweisen, und die damit die Funktionstchtigkeit der Strafrechtpflege gefhrdet.'3 Fr die anderen dagegen steht 153a im Zentrum der Kritik opportuner Einstellungsvorschriften. 4 Diese Kritik entstand bereits vor der Verabschiedung der Norm durch den Gesetzgeber und ist auch seither im rechtswissenschaftlichen Schrifttum, wenn auch mit unterschiedlicher Intensitt, nie ganz verstummt.5 Vorliegend sollen nun verschiedene Anstze dieser Kritik berprft werden, um aufzuzeigen, welche Gesichtspunkte diese Norm so schwierig gestalten und ob diese auch standfest sind.
