Die Schuldrechtsreform 2002 hat die Schadensersatzregelungen im Leistungsstrungsrecht grundlegend gendert. Es stellt sich die Frage, wie die verschiedene Schadensersatzansprche nach 280 ff., 311a Abs. 2 BGB voneinander richtig abgegrenzt werden sollen. Trotz intensiver Beschftigung der Rechtsprechung und Literatur besteht bis heute keine bereinstimmende Antwort. In diesem Buch wird versucht, diese Frage anhand der Systematik der Schadensersatzregelungen zu lsen. Der Systematik entsprechend wird zunchst untersucht, wodurch sich die Schadensersatzansprche auf der Rechtsfolgeseite unterscheiden. Anschlieend wird auf die Abgrenzung auf der Tatbestandseite eingegangen, wobei die Pflichtverletzung und der Bezugspunkt des Vertretenmssens der einzelnen Schadensersatzansprche dargestellt und verglichen werden sollen. Schlielich wird unter Anwendung dieser zweistufigen Abgrenzung versucht, die typischen mangelbedingten Schadenspositionen im kaufrechtlichen Gewhrleistungsrecht richtig einzuordnen.
