Mxico tuvo que promulgar una nueva Ley de Inversin Extranjera y reformar su Ley Ambiental para cumplir con sus obligaciones dentro del Tratado. Sin embargo esto ha creado la polmica de que los Estados pueden utilizar al ambiente como medida proteccionista ya que hasta el momento no se ha diseado una forma efectiva de calcular los costos ambientales. Metalclad Corp., una empresa norteamericana especializada en el tratamiento y confinamiento de Residuos Peligrosos, vio en Mxico un mercado muy amplio y poco explotado. En 1993, compr un Confinamiento de Residuos Peligrosos en San Luis Potos, sin embargo debido a presiones de la sociedad civil y del gobierno local y municipal tuvo que cerrar debido a la mala disposicin de 55,000 toneladas que afectaron la zona. Metalclad llev al gobierno mexicano a Panel Internacional por violaciones del Captulo XI del TLCAN cuya resolucin fue desfavorable para Mxico, teniendo que pagar una indemnizacin de ms de 16,000,000 dlares.
