Product DescriptionRechtsprechung und herrschende Lehre halten eine aufgedrngte Nothilfe grundstzlich fr rechtswidrig. Ein Nothelfer darf danach einen Angegriffenen nicht gegen dessen Willen vor einem Angreifer verteidigen. Untersuchungsgegenstand der Arbeit ist, ob dieses Ergebnis mit den Grundgedanken des 32 StGB bereinstimmt. Es wird aufgezeigt, dass eine Anbindung der Nothilfe an den Willen des Angegriffenen Schwierigkeiten bereitet, wenn der Rechtfertigungsgrund des 32 StGB sowohl mit dem Individualschutz des Angegriffenen als auch mit prventiven Gesichtspunkten wie der Verteidigung der Rechtsordnung begrndet wird. Die Untersuchung kommt zu dem Ergebnis, dass Notwehr und Nothilfe durchaus individualistisch erklrt werden knnen. Aus diesem Grund kann der Wille des Angegriffenen bei der Nothilfebefugnis Dritter in Einzelfllen bercksichtigt werden und eine aufgedrngte Nothilfe rechtswidrig sein. Nach der ratio legis des 33 StGB ist eine solche Nothilfe aber nicht zu bestrafen, wenn sich der Nothelfer aus Furcht um den Angegriffenen dazu hinreien lsst, den Angegriffenen gegen dessen Willen zu verteidigen und dabei die Rechtsgter des Angreifers verletzt.About the AuthorDer Autor: Rouven Seeberg wurde 1977 in Lehrte geboren. 1998 nahm er das Studium der Rechtswissenschaften an der Universitt Gttingen auf und arbeitete dort von 2000 bis 2004 als Mitarbeiter am Lehrstuhl fr Brgerliches Recht, Medizinrecht, Internationales Privatrecht und Rechtsvergleichung. Nach der Ersten juristischen Staatsprfung 2003 absolvierte der Autor sein Referendariat im Bezirk des Oberlandesgerichts Braunschweig. Die Promotion erfolgte 2004 an der Universitt Gttingen.
