La autonoma de la voluntad es un principio bsico del Derecho contractual, que encuentra su fundamento en el hecho de ser considerado como una manifestacin de la libertad del individuo. Este principio en la actualidad se encuentra en decadencia, lo cual se debe a las restricciones que le son impuestas. Por ello la presente investigacin tiene como objetivo realizar un estudio sobre los principales factores jurdicos y sociales que permiten demostrar la decadencia actual del principio de autonoma de la voluntad en la regulacin de las obligaciones contractuales civiles. El aludido estudio se realiza teniendo como base las diferentes posiciones adoptadas por la doctrina, relacionadas con el tema, a fin de argumentar la importancia de preservar uno de los principios ms importantes en el Derecho Civil.
