Bisweilen wurden diese Einrichtungen als unverzichtbare Manahmen zur Rettung von sicher dem Tode geweihten Neugeborenen und Kleinkindern deklariert. Zunchst stellt der Verfasser die beiden Einrichtungen vor, wobei Funktion und Zweck erlutert werden sollen. Weiter werden die potentiellen Nutzer benannt, indem Personen und Ursachen vorgestellt werden, die nach Erkenntnissen bisher als Kindesaussetzer und Grnde der Aussetzung und Ttung aufgetreten sind. Anschlieend wird ein kurzer historischer Abriss ber Kindesaussetzungen und die historischen Vorlufer der Einrichtungen geboten. Hier wird auf die Findelhuserproblematik und das Versagen der sog. Drehlade in der Geschichte eingegangen. Im dritten Teil werden die Einfachrechtlichen Aspekte (in Bezug auf Betreiber und Aussetzende) dargestellt. Es wird jedoch im Rahmen des Seminars verzichtet, auf zivilrechtliche Probleme einzugehen. Vielmehr sind im Bereich des ffentlichen Rechts die strafrechtlichen Probleme von Bedeutung. Als solche kommen insbesondere die Unterhaltspflichtverletzung und die Personenstandsflschung in Betracht. Der wesentliche Schwerpunkt liegt auf der Errterung der verfassungsrechtlichen Probleme. Hier stellt sich als zentrale Frage, ob das Recht auf Kenntnis der eigenen Abstammung durch den vermeintlichen Schutz des Lebens eingeschrnkt werden kann. Es findet diesbezglich eine Abwgung der Grundrechts und Interessenkollision statt. Es wird aber ebenso auf verfassungsrechtlich verbrgte Eltern und Familienrechte und Persnlichkeitsrechte der Mutter eingegangen, die ebenfalls eingeteilt nach Pro und Contra Positionen bewertet werde
