Mit Ablauf der urheberrechtlichen Schutzfrist, die in Deutschland bereits durch 64 des Gesetzes ber Urheberechte und verwandte Schutzrechte (UrhG) vom 9. September 1965 und aufgrund der Richtlinie 93 / 98 / EWG vom 29.10.1993 zur Harmonisierung der Schutzdauer des Urheberrechts und verwandter Schutzrechte (im Folgenden: Schutzdauerrichtlinie) nunmehr auch in smtlichen EU Staaten auf 70 Jahre post mortem auctoris festgelegt wurde, endet das Urheberecht. In der Folge wird das Werk gemeinfrei, jedermann darf es ohne Zustimmung der Erben des Urhebers frei verwerten. In Ausnahmefllen kann sich jedoch ein weiterer Schutz durch dass allgemeine Brgerliche Recht, das Wettbewerbsrecht und durch ffentlich rechtliche Vorschriften, insbesondere des Denkmalschutzes, ergeben. Die zeitliche Begrenzung des Schutzes des Urheberrechts ist nicht selbstverstndlich. So kennt das Sachenrecht eine solche zeitliche Befristung nicht. Die Beschrnkung des Urheberrechts rechtfertigt sich jedoch nach herrschender Meinung aus der Annahme, dass Werke der Literatur, Wissenschaft und Kunst ihrer Natur nach Mitteilungsgut und daher von besonderer Bedeutung fr die Allgemeinheit sind. Die urheberrechtliche Schutzfrist soll damit den geistigen und wirtschaftlichen Interessen des Urhebers und seiner Erben als auch den Interessen der Allgemeinheit an einem freien Zugang zum Immaterialgut angemessen Rechnung tragen. Die zeitliche Beschrnkung des Urheberechts ist im brigen im Hinblick auf Art. 3 und Art. 14 GG als verfassungsrechtlich unbedenklich angesehen worden.
