Seit Dezember 2001 ist China Mitglied der Welthandelsorganisation (WTO). Durch die Unterzeichnung des Beitrittsvertrags hat sich die Volksrepublik zu einer vollstndigen sowie unmittelbaren Umsetzung des Abkommens ber die handelsbezogenen Aspekte der Rechte des geistigen Eigentums (TRIPS) verpflichtet. Dennoch wird China hufig fr den Umgang mit geistigem Eigentum kritisiert. ber fnf Jahre nach dem Beitritt zur WTO wird in dieser Studie untersucht, wie gut die Vereinbarungen mit der WTO von der VR China eingehalten werden. In diesem Buch werden zunchst die spezifischen Eigenschaften von geistigem Eigentum, unter anderem mittels einer spieltheoretischen Implikation, verdeutlicht. In einem nchsten Schritt werden die Vereinbarungen auf dem Gebiet des geistigen Eigentums erlutert. Im anschlieenden und wesentlichen Teil der Untersuchung wird detailliert analysiert, warum es der VR China noch immer nicht gelungen ist, einen adquaten Schutz des geistigen Eigentums zu gewhrleisten. Dabei wird gezielt zwischen formalen Zugestndnissen fr die Rechteinhaber und Rechtsdurchsetzungen unterschieden. Die Studie zeigt, dass der VR China bei mehreren Artikeln des Abkommens eine ausreichende Umsetzung gelungen ist. Dennoch fhren vor allem ein mangelndes Bewusstsein fr geistiges Eigentum sowie eine unzureichende chinesische Durchsetzung der Rechte des geistigen Eigentums zu hufigen Rechtsverletzungen.
