A partir del 1 de abril del ao 1994, con la entrada en vigencia de la Ley 100 de 1993, los colombianos afrontaron un cambio radical en la estructura del sistema pensional del pas, que afect principalmente a aquellos que por su edad o por su tiempo de cotizacin tenan una expectativa cercana a obtener una prestacin pensional. Dado el efecto ocasionado por este empalme de legislaciones, la propuesta de este trabajo investigativo se encamina principalmente a estudiar los conflictos y el impacto producido con la aplicacin de esta norma, orientado a los casos de personas pertenecientes al rgimen de transicin y cuyo derecho pensional debe ser estudiado y resuelto en instancias judiciales, dado el inters surgido hacia esta clase de procesos al acceder a los mismos a travs de la instancia judicial laboral y de la seguridad social colombiana.
