In diesem Zusammenhang wiegt die besondere Bedeutung der Banken und ihrer Aufgaben schwer. Hier gab es ebenfalls im Bereich der ffentlichrechtlichen Kreditinstitute Probleme. Dabei mssen nicht nur die direkt beteiligten Landesbanken die Verantwortung bernehmen. Auch wenn die Sparkassen nicht direkt beteiligt waren und sich ihr Geschftsmodell in der Krise als stabil erwiesen hat, muss die Frage gestellt werden, warum sie als Miteigentmer der Landesbanken die Geschfte mit den undurchsichtigen Kreditverbriefungen nicht verhindert haben bzw. verhindern konnten. Eine funktionierende Corporate Governance soll genau das durch Transparenz und Zusammenwirken von Fhrungs und Kontrollorgan verhindern. Ziel dieser Arbeit ist es, den aktuellen Stand der Umsetzung im Bereich Corporate Governance von Landesbanken und Sparkassen zu beleuchten und Lcken und Diskussionsbedarf aufzuzeigen. Dazu wird zunchst das ntige theoretische Fundament gelegt. Als erste theoretische Grundlage wird die PrinzipalAgentTheorie diskutiert. Anschlieend werden nach der Klrung des Begriffs Corporate Governance bestehende Kodifizierungen kurz erlutert und zum Abschluss des Kapitels die Strukturen im Sparkassensektor dargelegt. Daraufhin wird die Umsetzung der Corporate Governance (CG) bei Landesbanken und Sparkassen diskutiert. Hier wird speziell auf die mglichen PrincipalAgentKonflikte eingegangen und diese in Bezug dazu auf die Besonderheiten im ffentlichen Sektor errtert. Eine besondere Wrdigung soll der Verwaltungsrat der Sparkassen erfahren, bevor eine kritische Betrachtung stattfindet und in der Schlussbetrachtung die Ergebniss
