Im weiteren Verlauf errtert die Arbeit die europarechtliche Seite des Problems und arbeitet den bisherigen Meinungsstand heraus. Auf der Grundlage der Rechtsprechung des EuGH werden die Lsungswege in der deutschen Rechtspraxis kritisch analysiert. Es zeigt sich, dass die Zuhilfenahme des ordre public abzulehnen ist. Auch das Sekundrinsolvenzverfahren bietet den Glubigern keinen hinreichenden Schutz. Die Konflikte sind deshalb ber die Bestimmung des Interessenmittelpunkts zu lsen.About the AuthorDer Autor: Jens Christoph Rainer Heneweer wurde in Essen geboren und studierte Rechtswissenschaften an der Universitt Mnster.
