Der Autor zeichnet die germanistische Diskussion um das geteilte Eigentum nach und stellt fest, da sich die Lehre vom geteilten Eigentum in der germanistischen Lehre von Runde ber Eichhorn, Mittermaier, Beseler und Gierke bis zum BGB behauptet hat. Fr das 20. Jahrhundert werden die Versuche der Rechtswissenschaft und der Rechtsprechung analysiert, das geteilte Eigentum im Zusammenhang mit bestimmten Rechtsphnomenen wiederzubeleben. Eine zentrale Bedeutung kommt dabei den fiduziarischen Sicherungsrechten und insbesondere der Wohnraummiete zu.
