Die Priorittsregelungen der PV, des EP und des 40 des deutschen Patentgesetzes (PatG) sollen trotz unterschiedlichen Wortlauts inhaltsgleich sein. EP und 40 PatG setzen dieselbe Erfindung fr das Priorittsrecht voraus, nicht dagegen die PV. Die vorliegende Untersuchung beantwortet die Frage, unter welchen Voraussetzungen die Priorittsregelungen zu gleichen Handhabungen fhren knnen. Hierfr ist eine Untersuchung des Begriffs Erfindung im PV und EP sowie im deutschen Patentrecht vor 1978 und seit 1978 vorgenommen worden. Praktische Konsequenzen sind anhand von Beispielen erlutert.
