Die biomedizinische Forschung hat in den letzten Jahren groe Fortschritte gemacht und zum Teil spektakulre Ergebnisse erzielt. Ein wichtiger Forschungsbereich ist die Forschung mit embryonalen Stammzellen. Das deutsche Stammzellgesetz reguliert diese Forschung und den Umgang mit embryonalen Stammzellen. Die Untersuchung setzt sich mit der Frage auseinander, inwieweit das deutsche Stammzellgesetz mit den Regelungen des Welthandelsrechtes vereinbar ist. Dabei wird zunchst auf die Entstehung des Stammzellgesetzes und die zugrunde liegende ethische Debatte eingegangen. In einem rechtsvergleichenden Teil werden die rechtlichen Situationen in 13 Staaten sowie bestehende internationale Regelungen dargestellt. Auf dieser Grundlage wird sodann untersucht, ob embryonale Stammzellen Waren im Sinne des GATT sind und ob die Regelungen des Stammzellgesetzes Handelsbeschrnkungen nach den Vorschriften des GATT darstellen.
