Die Kriminologie liefert die Fakten, die Wahrheit; sie sagt, wie die Dinge stehen, und prophezeit uns vielleicht gar noch wie sie sich unter dem Einfluss einer bestimmten Strafjustiz entwickeln werden. Und die Kriminalpolitik setzt mit Augenma ins Werk, was Strafrecht und Kriminologie zuvor gemeinsam hervorgebracht haben. (...) Die Gerechtigkeit aus dem Strafrecht, die Wahrheit aus der Kriminologie und die praktische Vernunft aus der Kriminalpolitik im abgestimmten Miteinander frwahr ein Paradies (...)." Diese Passage stammt aus einem Aufsatz von Winfried Hassemer aus dem Jahr 2005. Folgt man seiner Ansicht, so sind die Disziplinen, des Strafrechts, der Kriminologie und der Kriminalpolitik leicht abgrenzbar und liefern dennoch mit ihren eigenen Methoden ein funktionales, harmonisches Ergebnis, ohne das es zu bergriffen in den jeweiligen Bereich des anderen kommt. Doch entspricht diese Aussage der Lebenswirklichkeit, oder ist sie vielmehr eine Utopie? Im Folgenden soll das Wirken der einzelnen Disziplinen des Strafrechts, der Kriminologie und der Kriminalpolitik, unter besonderer Bercksichtigung der Entwicklung zu einem eigenen Tatbestand der Nachstellung vorgestellt werden. Den Abschluss der Arbeit bildet die verfassereigene Stellungnahme in der einerseits die Aussage von Winfried Hassemer und andererseits der 238 StGB (Nachstellung) bewertet wird.
