Qu es el Estado Constitucional? Cules son las relaciones que deben existir entre Estado y ciudadana? Cules son los lmites de la Democracia en el Estado Constitucional? La reciente experiencia colombiana ha brindado algunos elementos de anlisis que pueden ayudar a contestar algunos de stos interrogantes. En el presente trabajo se defender la tesis que entiende que el Estado Constitucional, como elemento estructural del constitucionalismo global contemporneo, supone definir una relacin especfica entre ciudadana y Constitucin que permita la interiorizacin de un ethos orientado a la participacin democrtica y la defensa activa de los derechos fundamentales por parte de la ciudadana. Por tal razn, sostendremos que la Accin Pblica de Inconstitucionalidad, adoptada por Colombia en 1910 constituye una herramienta fundamental en el proceso de construccin de ciudadana participativa y, por tanto, en la plena consolidacin del Estado Constitucional incorporado en la Constitucin colombiana de 1991.
