Die Beschaftigung mit dem Phanomen Denunziation hat innerhalb der Geschichtswissenschaft Konjunktur. Das historiographische Interesse richtete sich zunachst auf die Bedeutung von Denunziationen fur das Funktionieren des nationalsozialistischen Unterdruckungsapparates. Zeitlich weiter zuruckgreifende Arbeiten thematisierten in der Folgezeit die Ambivalenz der Denunziation, die Herrschern wie Beherrschten als Machtmittel diente. Die Abhandlung greift diese Ansatze auf, geht jedoch einen anderen Weg. Nicht die Geschichte der Denunziation ist ihr Gegenstand, sondern die Entstehung und Ausgestaltung eines strafprozessualen Rechtsinstituts, der denunciatio. Dargestellt wird der institutionelle Rahmen, innerhalb dessen verschiedene Formen der Justiznutzung erst moglich wurden. Der Beobachtungszeitraum erstreckt sich vom fruhen 13. Jahrhundert bis zum Erlass der Reichsstrafprozessordnung im Jahre 1877. Berucksichtigung finden ausserdem begriffsgeschichtliche Aspekte, die Abgrenzung zwischen neutraler Anzeige und verachtlicher Denunziation sowie die institutionelle Bedeutung von Strafanzeigen im Rechtsstaat. Die Abhandlung stellt das Rechtsinstitut der denunciatio durchgehend und epochenubergreifend in den Kontext des jeweils gultigen Verfahrensrechts; sie versteht sich als Beitrag zur Geschichte des Strafprozessrechts.
