Die Arbeit wurde 2004 mit dem Promotionspreis der Commerzbankstiftung ausgezeichnet.Rechtsprechung und Literatur im Strafrecht differenzieren beim Anstellungsbetrug zwischen der Erschleichung einer Beamtenstellung und der Erschleichung eines Arbeitsverhltnisses und reduzieren die Probleme allein auf die Bestimmung des Vermgensschadens. Diese Untersuchung zeigt, dass der Anstellungsbetrug aber auch arbeits und beamtenrechtliche Problemstellungen aufwirft. Zunchst werden daher die arbeitsrechtliche und die beamtenrechtliche Einstellungsentscheidung untersucht. Eine strafrechtliche Betrachtung des Anstellungsbetruges schliet sich an. Die im Hinblick auf die unterschiedliche Behandlung der Tuschung des Bewerbers im Arbeits, Beamten und Strafrecht auftretenden Wertungswidersprche werden schlielich vor dem Hintergrund der Einheit der Rechtsordnung einer harmonisierenden neuen Lsung zugefhrt.
