Auch fr den umgekehrten Fall, dass ein deutsches Unternehmen eine Betriebssttte in einem anderen Staat unterhlt (sog. OutboundFall), spielt die Betriebssttte bei der deutschen Besteuerung eine nicht unerhebliche Rolle. Egal welchen der beiden Flle man betrachtet, sobald ein Unternehmen in mindestens zwei Staaten ttig wird, kommt man um den Begriff der Betriebssttte nicht mehr herum. Dies gilt sowohl fr das nationale deutsche Steuerrecht, als auch fr das jeweils andere nationale Steuerrecht. Um eine doppelte Besteuerung zu verhindern, hat Deutschland mit den meisten anderen Staaten sog. DBA abgeschlossen, die das Besteuerungsrecht entweder dem einen oder dem anderen Staat zuordnen. Vorbild fr die DBA sind dabei in erster Linie das OECDMA und vereinzelt auch das UNMA. Auch in den Fllen, in denen ein DBA abgeschlossen wurde, regelt der Artikel 7 OECDMA die Verteilung von Unternehmensgewinnen am Merkmal der Betriebssttte (sog. Betriebsstttenprinzip). Es geht letztlich immer um die Frage, welcher Teil der Einknfte des Unternehmens, ist welcher Betriebssttte zuzurechnen. Die OECD hat dabei den Artikel 7 im Entwurf ihres Musterabkommens im Jahr 2010 einer grndlichen Neuerung unterzogen. Diese Neuerung bildet den Anlass fr diese Arbeit. Sie sollen im Folgenden dargestellt und nher untersucht werden. Zuerst geht es dabei um den elementaren Grundbegriff: Was ist berhaupt eine Betriebssttte? Betrachtet und erlutert wird dabei sowohl die nationale deutsche Definition, als auch die Definition, die das OECDMA enthlt. Auch sollen einige Sonderformen kurz dargestellt werden, die in der internationalen Praxis vermehrt auftauchen und einige Abgrenzungsschwierigkeiten bilden. Der zweite Teil befasst sich anschlieend mit einigen Vorberlegungen, welche der eigentlichen Einknfteabgrenzung vorausgehen. Seine Schwerpunkte und Interessen liegen im internationalen Steuerrecht, bei Verrechnungspreisen, Fonds sowie der Unternehmens und Vermgensnachfolge. Er ist Autor mehrerer Verffentlichungen auf dem Gebiet des Steuer, Gesellschafts und Kapitalmarktrechts. Zurzeit ist er in einer renommierten Wirtschaftsprfungs und Steuerberatungsgesellschaft in Berlin ttig.
