Product Description Der Grundsatz der Subsidiaritt wird als keystone und caractristique fondamentale der EMRK bezeichnet und auch in der Rechtsprechung der EGMR immer wieder betont. Ausdrcklich genannt wird er in der EMRK allerdings nicht. Diese Arbeit hat sich deshalb zum Ziel gesetzt, seine rechtliche Fundierung, seine Besonderheiten und seine Bedeutung im System der EMRK zu untersuchen und aufzuzeigen. Dabei wurde die Subsidiarittsrechtsprechung des EGMR systematisiert und analysiert. Der Grundsatz der Subsidiaritt wurde in ein Verhltnis zu anderen Besonderheiten der Rechtsprechung und Aufgaben des EGMR gesetzt und auch mit der Subsidiarittsidee der katholischen Soziallehre, der Subsidiaritt der Verfassungsbeschwerde und dem Subsidiarittsprinzip im Kontext der EU verglichen. About the Author Die Autorin: Irene Hoffmann wurde 1973 in Freiburg i. Brsg. geboren. Sie studierte Jura an der Universitt Freiburg i. Brsg. und legte dort das 1. juristische Staatsexamen ab. Im Anschluss daran absolvierte sie einen Postgraduiertenstudiengang an der University of Aberdeen (Schottland), den sie mit dem Master of Private International & Commercial Law abschloss. Auf das Referendariat im OLGBezirk Schleswig folgte die Promotion sowie u.a. ein Praktikum am Europischen Gerichtshof fr Menschenrechte.
