Product DescriptionDie Charta der Grundrechte erkennt die unternehmerische Freiheit in Art. 16 lediglich nach dem Unionsrecht und den einzelstaatlichen Rechtsvorschriften und Gepflogenheiten an. Ausgehend von diesem Wortlaut verfolgt das Buch die Frage, welchen Schutz diese zaghaft formulierte Freiheitsgarantie tatschlich zu leisten im Stande ist. Zur Beantwortung dieser Fragestellung wird das Grundrecht der unternehmerischen Freiheit unter Heranziehung einschlgiger Bezugsquellen inhaltlich konkretisiert. Auf der Grundlage einer rechtsvergleichenden Untersuchung widmet sich der Autor dabei zunchst der Ausformung der materiellen und personellen Reichweite der unternehmerischen Freiheit. In einem abschlieenden Analyseschritt werden die durch die Charta eingerumten Beschrnkungsmglichkeiten der grundrechtlichen Garantie und deren Verhltnis zueinander aufgezeigt. Vor dem Hintergrund dieser Untersuchung kommt der Autor zu dem Schluss, dass der materiell und personell durchaus extensive Schutzbereich der unternehmerischen Freiheit durch die unzureichende Schrankenregelung der Grundrechtecharta erheblich relativiert wird.About the AuthorDer Autor: Henning Schwier, geboren 1977 in Minden, studierte von 1997 bis 2003 Rechtswissenschaft und Europische Rechtspraxis an den Universitten Hannover und Kopenhagen. Zum Ende des Jahres 2003 nahm er das Promotionsstudium an der Universitt zu Kln auf. Seit Mitte 2006 ist der Autor Rechtsreferendar am Oberlandesgericht Celle.
