Der nationale Status einer Person erlangt an mehreren Schnittstellen des Transplantationswesens Bedeutung. Es geht um die Fragen, ob und unter welchen Voraussetzungen im Ausland entnommene Organe nach Deutschland zu Transplantationszwecken importiert und ob auslndischen hirntoten Brgern in Deutschland Organe zu Transplantationszwecken entnommen werden drfen. Hinzu kommt die Problematik des Zugangs auslndischer Brger zum deutschen Transplantationswesen. Die Arbeit fragt danach, ob im Bereich der Transplantationsmedizin ein fortdauerndes differenziertes Recht zwischen Deutschen, Unionsbrgern und Auslndern aus Drittstaaten rechtlich hinnehmbar ist und ethischen Grundwerten der Gesellschaft entspricht. Es wird untersucht, ob die Transplantationsindikation als weltumspannendes Gesundheitsproblem Halt vor nationalen Grenzen machen darf oder aber sich auf der Ebene einer transnationalen Gesellschaft an den globalen Grundwerten orientieren muss.
