Product DescriptionGegenstand dieser Arbeit ist die Untersuchung des Geldwschetatbestandes ( 261 StGB) als ein typisches Beispiel moderner Strafgesetzgebung. Wie von einer Vielzahl neuerer Gesetzesvorhaben genannt sei nur der sog. Groe Lauschangriff versprach man sich auch von dieser Norm einen wesentlichen Beitrag zur Bekmpfung der organisierten Kriminalitt. Bereits aus dieser Formulierung wird deutlich, da der Tatbestand berwiegend prventiv ausgerichtet ist und zwar mit der sog. organisierten Kriminalitt auf ein Phnomen, das nach Art und Umfang so unbestimmt ist, da zumindest gegenwrtig verlliche Aussagen hierber nicht mglich sind. Dies hat weitreichende Auswirkungen auf die Ausgestaltung des Tatbestandes. Mit 261 setzt sich der Gesetzgeber auf Kosten materieller Gerechtigkeit bewut ber die wesentlichen Kategorien des klassischen Strafrechtssystems sowie die grundlegenden Vorgaben der Verfassung hinweg. Statt materielles Unrecht zu begrnden, dient die Norm vor allem dazu, die aktive Mitarbeit der Bevlkerung beim Vorgehen gegen die organisierte Kriminalitt zu erzwingen; daneben hat sie aber auch symbolische und rein populistische Zwecke.About the AuthorDer Autor: Johannes Knorz, geboren 1964, studierte Rechtswissenschaften an der Freien Universitt Berlin und an der RuprechtKarlsUniversitt in Heidelberg.
