Der Verfasser gelangt zu dem Ergebnis, da das Vollstreckungsgericht a) (auch) bei aufgehobenen Schiedssprchen ein (begrenztes) Anerkennungsermessen hat und b) bei gnstigerem nationalen Recht sogar anerkennen und vollstrecken mu. Liberaleres nationales Recht und ein Anerkennungsermessen des Vollstreckungsgerichts trotz Vorliegens eines Versagungsgrundes sind auch ganz allgemein der Schlssel zur Fortentwicklung des heute oft als zu restriktiv empfundenen New Yorker UNbereinkommens von 1958.
