Product DescriptionDiese Arbeit beschftigt sich mit einer Darstellung und Analyse der Begrndung und Beendigung von Arbeitsverhltnissen und Arbeitsvertrgen nach dem Recht der Volksrepublik China. Im Vordergrund steht die nationale Rechtslage nach dem Inkrafttreten des Arbeitsvertragsgesetzes im Jahr 2008. Daneben wird auf lokale Rechtsvorschriften eingegangen. Ziel der Arbeit ist neben dem berblick ber das nationale Recht eine Systematisierung nach dem Vorbild des deutschen Arbeitsrechts. Es wird mit den Mitteln des Rechtsvergleichs gearbeitet, um die dogmatischen Unterschiede und die Folgen fr Arbeitsvertrag und Arbeitsverhltnis in der Praxis herauszuarbeiten. Deutlich wird, dass trotz des erkennbaren Einflusses kontinentaleuropischen und deutschen Vertrags und Arbeitsrechts historisch, kulturell, politisch und wirtschaftlich bedingte chinesische Einflsse zu einem unterschiedlichen (Rechts)Verstndnis und einer abweichenden Rechtsgestaltung fhren.About the AuthorNils Seibert arbeitet als deutscher Rechtsanwalt und Senior Counsel in Shanghai. Nach dem Abschluss des Zweiten juristischen Staatsexamens in RheinlandPfalz 2007 begann er mit seiner Dissertation an der Universitt Gttingen. Parallel hierzu arbeitete er als Rechtsanwalt in Frankfurt am Main. 2009/2010 studierte er Chinesisch an der Fremdsprachenuniversitt Peking.
