B. Grund und Boden oder Maschinen, die den grten Wertanteil in einem Unternehmen ausmachten, so sind es heute immaterielle Vermgenswerte wie z. B. Marken, Knowhow und andere gewerbliche Schutz und Urheberrechte, die wertvolle Wirtschaftgter fr ein Unternehmen darstellen. Immer mehr Unternehmen versuchen daher ihre technischen und rechtlichen Ressourcen besser zu nutzen und berlassen ihre Schutzrechte fr eine angemessene Lizenzgebhr an Dritte.2 Die Ermittlung der Lizenzgebhr ist fr die Unternehmen dabei von hchster Relevanz, da sie zur Nutzungsberlassung angemessene Verrechnungspreise ansetzen mssen. Die Bestimmung von Lizenzgebhren ist ebenfalls bei Rechtsverletzungen (z. B. unrechtmige Nutzung einer Marke) von groer Bedeutung, um den eingetretenen Schaden zu quantifizieren.3 Das Ziel der vorliegenden Arbeit ist die Bestimmung von Lizenzgebhren auf der Grundlage von konomischen und juristischen berlegungen. Dazu werden im Folgenden verschiedene Methoden und Modelle zur Bestimmung von Lizenzgebhren vorgestellt und deren Vorzge und Nachteile aufgezeigt. Die Arbeit gliedert sich daher wie folgt: Zunchst werden im Kapitel 2 die Grundlagen des Licensing dargestellt, wobei einerseits das Lizenzgeschft und andererseits die rechtlichen Grundlagen nher erlutert werden. In Kapitel 3 werden dann zur Ermittlung einer angemessenen Lizenzgebhr fnf betriebswirtschaftliche Methoden der Lizenzbewertung im Einzelnen vorgestellt.
