Besonders deutlich wird diese Wechselwirkung bei der Rcknahme gemeinschaftsrechtswidriger Beihilfen und beim Rechtsschutz fr Konkurrenten von Beihilfeempfngern.Die vorliegende Untersuchung zeigt und bewertet die vielfltigen Einwirkungen des EGBeihilferechts auf das deutsche Verwaltungsverfahrensrecht im Falle der Rckabwicklung von Beihilfeverhltnissen. Der Verfasser arbeitet die Mglichkeiten europarechtskonformer Auslegung des deutschen Rechts, aber auch die Ansatzpunkte fr eine gesetzgeberische Reform desselben heraus und fordert nachdrcklich eine noch intensivere Kooperation von Behrden und Gerichten mit den europischen Institutionen.
