Zum 01. Januar 2005 startete das Emissionshandelssystem in der Europischen Gemeinschaft. Hierzu hatten die Mitgliedstaaten nach Art. 4 der Emissionshandelsrichtlinie (2003/87/EG) sicherzustellen, dass die dem Anwendungsbereich der Richtlinie unterfallenden emittierenden Ttigkeiten nur dann durchgefhrt werden drfen, wenn der Anlagenbetreiber ber eine Genehmigung verfgt. Auf nationaler Ebenen stellte das TreibhausgasEmissionshandelsgesetz (TEHG) den entsprechenden rechtlichen Rahmen dar. Die Emissionsgenehmigung wurde konkret in 4 TEHG umgesetzt. In der vorliegenden Arbeit wird sich nun im Wesentlichen mit dem Regelungsinhalt dieser Norm, dem Rechtscharakter der Emissionsgenehmigung und ihrer Funktion sowie mit ihrer vormals geplanten Umsetzung im Umweltgesetzbuch (UGB) befasst. Besondere Aufmerksamkeit wird u.a. der Regelung des 4 Abs. 6 TEHG zu teil. Danach 'ist' bei so genannten Neuanlagen die immissionsschutzrechtliche Genehmigung zugleich die Emissionsgenehmigung. Insofern wird in der Arbeit die berlegung begrndet, dass der Gesetzgeber mit der Gleichstellung dieser Genehmigungen eine neue Variante gelegen zwischen einer gesonderten Genehmigungserteilung und der Konzentrationslsung im Zusammenspiel verschiedener Genehmigungen bei Vorliegen einer immissionsschutzrechtlichen Genehmigung kreiert hat. Letztlich hat der Gesetzgeber bei Schaffung des Emissionshandelsrechts sowohl mit dem bergang von ordnungsrechtlicher zu konomischer Verhaltenssteuerung als auch mit der Ausgestaltung der Emissionsgenehmigung, ihrem Rechtscharakter oder auch ihrer Funktion umweltrechtliches Neuland betreten.
