Strafgesetzbuch ihren Niederschlag gefunden. Gegenstand der vorliegenden Arbeit ist die Entwicklungsgeschichte der 89a, b StGB und ihre gesellschaftspoltische Bedeutung. Zunchst wird auf die gesellschaftspolitische Bedeutung letzterer einzugehen sein, um im Anschluss ihre Entwicklungsgeschichte aufzuzeigen. Im Rahmen der Betrachtung der Entwicklungsgeschichte soll auf die europischen Anste, die verschiedenen Gesetzesentwrfe und die Einwnde der Literatur eingegangen werden sowie eine Stellungnahme der Verfasserin erfolgen. Die Darstellung der Einwnde und die dazugehrige Stellungnahme erfolgt dabei fr den zweiten bis vierten Entwurf gemeinsam. Den Abschluss der Arbeit bilden die Beantwortung der Frage, wieso sich der Gesetzgeber fr die heutige Fassung der 89a, b entschieden hat, sowie ein Fazit.
