Das Thema dieses Buches ist die Verfassungsreform in der Bun desrepublik nach der Vereinigung. Das Jahr 1989 markiert fr das Grundgesetz in zweifacher Hinsicht einen deutlichen Einschnitt: Zum einen wurde in einer Vielzahl von Gedenkveranstaltungen zum vierzigjhrigen Jubilum des Grundgesetzes dessen Lei stungsfhigkeit gerhmt, zum anderen begann mit dem Fall der Mauer und dem absehbaren Ende der deutschen Teilung auch eine Diskussion ber die Eignung des bestehenden Grundgesetzes als Verfassung des geeinten Deutschland und damit ber die Frage, ob und wie das "bewhrte" Grundgesetz gendert werden sollte oder mte. Fr die Vollendung der Einheit stellte das Grundgesetz in sei ner damaligen Form zwei Wege zur Verfgung: Nach Art. 146 GG a. F. konnte eine neue Verfassung erarbeitet werden, die mit ihrer Verabschiedung das Grundgesetz abgelst htte, oder die damalige DDR konnte nach Art. 23 GG a. F. ihren Beitritt zum Grundgesetz erklren, mit der Folge, da dann das Grundgesetz als Verfassung des vereinten Deutschland gegolten htte. Im Zu sammenhang mit der Entscheidung fr den Weg des Beitritts der neuen Lnder zur Bundesrepublik wurde in den Einigungsvertrag die Empfehlung aufgenommen, wonach sich die gesetzgebenden Krperschaften des vereinten Deutschland in der Folgezeit mit ei ner Reihe von Verfassungsfragen beschftigen sollten. Auf der Grundlage dieser Empfehlungen setzten Bundestag und Bundesrat im November 1991 die Gemeinsame Verfassungskommission (GVK) ein, die im Herbst 1993 ihre Empfehlungen zu einer Reihe von Verfassungsnderungen vorlegte.
