D. h., da politische Machtinstanzen regelmig in die Streitigkeiten zwischen einzelnen Personen oder Gruppen intervenieren. Die Herausbildung eines staatlichen Richteramtes setzt allerdings voraus, da die in nichtstaatlichen Gesellschaften bliche Selbsthilfe in allen Konfliktfllen zugunsten des Gerichtszwanges aufgegeben bzw. staatlich legitimiert wird. Auerdem ist es unerllich, da die Richtersprche auch vollstreckt, d. h. mit Gewalt durchgesetzt werden knnen . Daraus ergibt sich, zusammenfassend gesagt, die Suche nach der Gerichtsverfassung, die in Athen erstmals mit dem drakontischen Blutrecht greifbar und durch Solon weiterentwickelt wurde. Der Grund dafr ist, da die Gerichtsverfassung alle (oder wenigstens sehr viele) gesellschaftlichen Probleme, die den inneren Frieden eines Gemeinwesens nachhaltig stren knnen, mittels Institutionalisierung zu bewltigen sucht: D. h., die Gerichtsverfassung regelt mehr oder weniger genau, wie vorzugehen ist (d.h. welche Prozeduren anzuwenden sind), wenn Streitigkeiten zwischen einzelnen Personen oder Gruppen auftauchen, die den innergesellschaftlichen Frieden bedrohen knnen.
