Das Buch stellt die Ablehnungshaltung der deutschen Verfassungslehre gegenber sozialen Grundrechten auf den Prfstand. Von jeher streitet man sich darber, ob derartige Rechte einklagbar sein knnen und ob es sich berhaupt um echte Rechte handelt. In der Arbeit werden zwei Rechtssysteme (Sdafrika und Qubec) untersucht, welche sich durch die Aufnahme sozialer Grundrechte in ihre nationalen Verfassungen auszeichnen. Die dort vorhandene Rechtsprechung wird eingehend analysiert und die Ergebnisse werden sodann einer umfassenden Bewertung im Vergleich zum deutschen Verfassungsrecht unterzogen. Anhand dessen wird ein grundrechtsdogmatisches Konzept sozialer Grundrechte fr das deutsche Recht entwickelt und nachgewiesen, dass diese Rechte nicht nur justiziabel sind, sondern dass sie auch durchaus mit dem Grundgesetz vereinbar sind. Zwar erfordert dies eine modifizierte Dogmatik die wesentlichen Anstze sind jedoch in der Rechtsprechung des Bundesverfassungsgerichts bereits angelegt.
