Diese Aufgabe, die Hobbes noch als konstituierendes Element des Staates angesehen hat, ist in den modernen Staaten westlicher Prgung inzwischen zu einer Selbstverstndlichkeit geworden. Dabei dient der konstitutionelle Charakter der modernen Staatlichkeit als Absicherung des einzelnen Brgers vor dem souvernen Gewaltmonopol des Staates, welches zur Durchfhrung der genannten Aufgaben notwendig ist. Was aber geschieht in einer Situation, in der der Staat nicht mehr in der Lage ist, seiner Verpflichtung die Brger zu schtzen innerhalb des ihm von der Verfassung auferlegten Rahmens nachzukommen, da die notwendigen Manahmen weit ber das hinaus gehen wrden, was die Brger ihm im Normalfall an Kompetenzen zu zugestehen bereit waren, um einem mglichen Missbrauch durch die Staatsorgane zuvor zu kommen? Hier entsteht ein Spannungsfeld zwischen hypothetischen, nicht voraussehbaren Ausnahme oder Katastrophenfllen, fr die der Staat weitreichende Kompetenzen bentigt um seine Brger effektiv zu schtzen und der sich gleichzeitig daraus ergebenen Gefahr des Missbrauchs durch Verletzung grundlegender Prinzipien konstitutioneller Staaten wie dem Grundsatz der Gewaltenteilung, Wahrung der Grundrechte oder dem Grundsatz der Volkssouvernitt.
