Die Transplantationsmedizin leidet nach wie vor an einem erheblichen Organmangel. Die Zahl der Wartelistenpatienten, die dringend auf ein Spenderorgan angewiesen sind, bersteigt die Zahl der zur Verfgung stehenden Organe um ein Vielfaches. Die Begrndungen fr diesen seit Jahren unvernderten Zustand sind zahlreich. Unter anderem ist die Zusammenarbeit der an postmortalen Organtransplantationen beteiligten Institutionen immer wieder Kritik ausgesetzt. Das in 11 Abs. 1 S. 1 TPG festgelegte Kooperationsmodell der gemeinschaftlichen Aufgabe wird in seiner Grundstruktur und in seinen Auswirkungen auf die rechtliche Position der einzelnen Beteiligten ausfhrlich dargestellt. Dabei liegt der Schwerpunkt auf der Untersuchung und Abgrenzung der Kompetenzen sowohl der Transplantationszentren und Krankenhuser als auch der Deutschen Stiftung Organtransplantation (DSO), welche eine organisatorische Sonderstellung in dem Prozess einnimmt. Auerdem finden die haftungsrechtlichen Auswirkungen des Systems Beachtung, bevor der Autor notwendige nderungsvorschlge fr eine Verbesserung der Zusammenarbeit bei der postmortalen Organtransplantation unterbreitet.
