Im Gegensatz dazu ist der Glaube an die Invisible Hand' und die Selbstregulierung des Marktes in Zeiten eines Aufschwungs meist weiter verbreitet. Durch Regulierung soll Marktversagen verhindert bzw. Anreize fr ein marktkonformeres Verhalten geschaffen werden. Jedoch knnen durch die Gestaltung von Anreizen auch unerwnschte Nebenwirkungen entstehen, was historisch bereits mehrfach geschehen ist. So wollte beispielsweise die britische Kolonialregierung in Indien einer KobraPlage dadurch Herr werden, dass fr jede gefangene Kobra eine Rupie gezahlt wird, um somit durch das Fangen von Kobras zu incentivieren. Die Plage wurde dadurch jedoch noch strker, da sich die Aufzucht von Kobras als lukratives Geschft erwiesen hat. In der aktuellen Bankenregulierung wurde den Riskwheigted Assets' (RWA), aller guter Intention zum Trotz, eine Sonderstellung zuteil. So haben sowohl Banken als auch die Regulatoren selbst zum Entstehen gewaltiger OffBalance'Welten und einer Aufblhung des Schattenbankensystems beigetragen. Durch eine Anpassung des Regelwerks Basel II soll nun der offensichtlich gewordene Missstand seitens der Bankenaufsicht korrigiert werden. Wie eingangs bereits dargestellt, kann jedoch durch das Setzen falscher' Anreize das ursprngliche Problem weiter verschrft werden. Durch geschicktes Ausnutzen von Regulierungslcken konnte der eigentliche Grundgedanke der risikosensitiven Regulierung von Basel II umgangen, und zum Vorteil der Banken genutzt werden.
