Die vorliegende Arbeit ist im Wintersemester 1972/73 von der Juristischen Fakultat der Universitat Heidelberg als Habilitationsschrift angenommen worden. Sie geht auf einen schriftlichen Bericht zuriick, den ich fiir das Hei delberger Kolloquium iiber die richterliche Beilegung internationaler Strei tigkeiten im Sommer 1972 erstattet habe (in englischer Sprache abgedruckt in Band 62 dieser Reihe).
