Durch die Anerkennung von ungeschriebenen Freiheitsrechten gelang es dem Schweizer Bundesgericht, den Kanon der in der Bundesverfassung von 1874 geregelten individuellen Garantien entscheidend zu erweitern. Diese ungeschriebenen Freiheiten wurden ohne Anknpfung an den Verfassungstext unter Herausbildung verschiedener Kriterien frei entwickelt. Auch das Bundesverfassungsgericht hat Wege gefunden, individuelle Rechtspositionen zu strken. Methodisch geschieht dies hier allerdings immer durch die Anknpfung an benannte Garantien. Trotz der formalen Anlehnung an ausdrcklich geregelte Freiheiten entwickelte das Bundesverfassungsgericht dabei allerdings quasi eigene Tatbestnde und verselbstndigte, konsistente Rechtspositionen, so dass man auch hier von ungeschriebenen Freiheitsrechten sprechen kann. Zentrale Bedeutung kommt bei dieser Rechtsprechung Art. 2 Abs. 1 GG in seiner Auslegung als allgemeine Handlungsfreiheit zu. Obwohl beide Gerichte unterschiedliche rechtsdogmatische Anstze whlen, werden in beiden Rechtsordnungen hnliche Ergebnisse erzielt.
