Sie ermglichen Individuen und Medien, ihre Meinung frei zu uern und zu verbreiten. Durch die Teilnahme der Medien an der ffentlichen Diskussion, besonders bei politischen, wirtschaftlichen und gesellschaftlichen Fragen, leisten sie einen wichtigen Beitrag zum Erhalt der demokratischen Kultur. Innerhalb der Demokratie besitzen die freie Presse und der freien Rundfunk daher einen hohen Stellenwert. Auf welcher verfassungsrechtlichen Grundlage Medien und deren Vertreter tagtglich agieren, sowie die medienspezifischen Pflichten, die sich aus dem Grundgesetz fr den Staat ergeben, soll Gegenstand dieser Arbei sein. In diesem Zusammenhang soll in der vorliegenden Arbeit die Wirkung von Artikel 5 GG nher betrachtet werden. Die Arbeit beschrnkt sich auf eine Auseinandersetzung mit dem ersten Absatz des Art. 5 GG. Es soll erklrt werden, inwieweit das Grundrecht der Kommunikationsfreiheit in Art. 5 GG ein Abwehrrecht der Brger gegenber dem Staat ist. Auerdem soll gezeigt werden, dass der Staat darber hinaus verpflichtet ist, das freie Pressewesen und den freien Rundfunk institutionell zu garantieren. Wie sich diese institutionelle Garantie konkret auswirkt soll anhand einiger speziellen Mediengesetze und Grundsatzentscheidungen des BVerfG erlutert werden. Ferner soll anhand des LthUrteils gezeigt werden, inwieweit Art. 5 GG auf Rechtsnormen des Privatrechts eine mittelbare Drittwirkung besitzt.
