So ist es nicht denkbar, dass eine juristische Person ausschlielich Kenntnisse ber ihren rechtsgeschftlichen Vertreter erlangt. Insbesondere bei groen Organisationen muss daher auch der einfache Mitarbeiter als Wissensvertreter des Unternehmens gelten. Das Organ selbst muss weder alles hren noch alles sehen. Es ist jedoch sehr wohl verpflichtet die Weiterleitung der Informationen, die durch die Mitarbeiter, als Augen und Ohren des Unternehmens, weitergeleitet werden, ordentlich zu gewhrleisten. Die Rechtsprechung hat diesen Tatsachen mit der analogen Anwendung des 166 BGB Rechnung getragen.
