L'analyse de la dignit du condamn dans l'excution de sa peine privative de libert suppose d'tudier les conditions dans lesquelles il l'excute intramuros, puis dans la phase postcarcrale. La constatation du respect ou de la ngation de la dignit du condamn repose sur l'apprciation de l'adaptation et de la proportionnalit de l'atteinte porte ses spcificits humaines primaires ainsi qu' leurs supports, un objectif lgitime d'intrt gnral. Ainsi, si l'humanisation des conditions de dtention permet le respect de la dignit du condamn, sa responsabilisation et la rappropriation de sa condition humaine lui offrent les moyens de promouvoir sa dignit par la stimulation de ses potentialits humaines d'amlioration. Au contraire, dans la phase d'excution postcarcrale de la peine privative de libert, si la conception et la mise en oeuvre des mesures d'amnagement de peine semblent garantir le respect et la promotion de la dignit du condamn, l'introduction d'une "thique de conviction" de surveillance tatique du condamn emporte la ngation de sa dignit par une atteinte son autonomie,inadapte l'objectif de prvention de la rcidive criminologique.
