Die Richter hatten festgestellt, dass die unterschiedliche Besteuerung von Rentnern und Pensionren nicht mit dem Gleichheitsgrundsatz des Grundgesetzes vereinbar ist. Die entscheidende Neuregelung durch das Alterseinknftegesetz bedeutet fr den Rentner, dass deren Bezge nach und nach Neurentnerjahrgang fr Neurentnerjahrgang (Kohorte) steuerpflichtig werden. Dafr werden die whrend des Berufslebens in die Altersvorsorge eingezahlten Beitrge fr jeden Erwerbsttigen Schritt fr Schritt von der Einkommensteuer freigestellt. Zugleich haben sich die steuerlichen Rahmenbedingungen fr die betriebliche Altersversorgung verbessert. Das Alterseinknftegesetz hat zudem die Kapitallebensversicherung als eine besondere Art der Vermgensbildung ab dem 1. Januar 2005 korrekt eingeordnet. Diese Verunsicherung ist bei Rentnern und denen die es in nchster Zukunft werden deshalb so gro, weil es ngste hinsichtlich der Besteuerung und gegebenenfalls anfallende Nachzahlung gibt. Aber im gleichen Mae ist das Interesse an Mglichkeiten oder gar Chancen gestiegen. Um diese deutlich werden zu lassen muss zunchst klar gestellt werden, wie die Renten ab dem 1.
