El autor desarrolla un amplio marco terico sobre las distintas formas en que se puede manifestar esa inaccin del Estado, logrando distinguir a la inactividad material de la Administracin Pblica como una situacin ilegal de incumplimiento, en relacin con otros comportamientos pasivos de la Administracin. La dimensin prestacional del Estado social, supone no solamente que sea a lo que todo Estado debe aspirar, sino, y ms importante garantizar a los ciudadanos su completa efectividad. Constituye entonces la inactividad material de la Administracin Pblica, una infraccin al ordenamiento jurdico por omisin de un deber legal de obrar, de contenido material o tcnico (que obviamente no sea materialmente imposible de ejecutar). Por tanto, la presente obra es un honesto y esclarecedor aporte al conocimiento del tema, el cual invita a una reflexin profunda y a la bsqueda de correcciones constantes en la dinmica evolucin jurdica moderna. Vaya pues mi enhorabuena al profesional estudioso, al lector vido de informacin actual y veraz; pues sin duda encontrar con creces la satisfaccin a su inquietud intelectual en este libro que hoy llega a sus manos.
