El inters principal que motiv la realizacin de este texto, fue la necesidad de adentrarse en el anlisis de la fundamentacin de los derechos fundamentales a partir de la teora de la accin comunicativa, de la democracia deliberativa y de la reconstruccin que Habermas realiza del Estado de derecho moderno desde el principio discursivo. En esta medida los derechos fundamentales, en cuanto condiciones de posibilidad, legitiman un orden jurdico y poltico y, a su vez, en tanto construcciones, se fundamentan en la dinmica participativa y discursiva de los ciudadanos bajo condiciones de racionalidad e imparcialidad. Esta doble dimensin de los derechos fundamentales lleva necesariamente a tomar en consideracin dos aspectos centrales de la teora comunicativa habermasiana: primero, los presupuestos de entendimiento derivados de las pretensiones de validez y segundo, los mecanismos procedimentales discursivos.
