El tema que se desarrolla es el poder constituyente, enfocado en el proceso de creacin de la nueva Constitucin, que vivi Venezuela en 1999. La llegada del presidente Chvez al poder, estuvo marcada por la convocatoria al proceso para cambiar la Constitucin, en el marco de la llamada revolucin. Esto gener grandes discusiones jurdicas y polticas, las primeras orientadas por el respeto a los principios fundamentales del Estado de Derecho y as preservar la democracia y los derechos humanos; las segundas basadas en el criterio que defenda que el pueblo es el soberano y que su voluntad es superior a la Constitucin. En este libro se defiende la necesidad de juridificar el poder constituyente, como garanta de funcionamiento ptimo de la base de la regulacin estatal y como freno al autoritarismo y al populismo. La Constitucin como producto del poder soberano del pueblo, tiene como funcin primordial limitar en forma jurdica la accin del poder y en cumplimiento de tal fin resulta pertinente la regulacin normativa de los procedimientos a seguir para modificar su contenido. El pueblo deber siempre participar en este proceso en forma directa, como garanta democrtica.
