Product Description Die Arbeit befasst sich mit den im StGB verwendeten Gesetzestechniken zur Strafschrfung, insbesondere der Regelbeispielsmethode fr besonders schwere Flle. Es zeigt sich, dass die problematische, viel kritisierte Regelbeispielstechnik nicht wie zumeist aber angenommen der Exemplifikationsmethode des fast vergessenen Rechtswissenschaftlers Adolf Wach (1843 1926) entspricht und somit nicht auf dessen noch heute aktuellen Beitrag zur Legislativen Technik aus dem Jahre 1908 abzuleiten ist. Die berlegenheit der richtig verstandenen Wachschen Exemplifikationsmethode gegenber der Regelbeispielstechnik wird dargestellt und aufgezeigt, dass diese Methode ganz generell ein gelungener Mittelweg zwischen kasuistischer und generalisierender Gesetzestechnik sein kann. Diskutiert wird hierbei speziell der Vorschlag Schefflers, dass die Wachsche Exemplifikationsmethode auch eine taugliche Gesetzestechnik zur Vermeidung von sog. horizontaler Kasuistik sei.
