Product DescriptionDiese Arbeit untersucht, ob die aufgedeckte Verstndigungspraxis im Strafprozess sowie die Gesetzesreform vom 04.08.2009 zur Regelung der Verstndigung im Strafverfahren, sich mit dem Grundgesetz und der Strafprozessordung vereinbaren lassen und ob die Gesetzesreform eine taugliche Regelung dieser Praxis darstellt. Dabei wird deutlich, dass einfache Erklrungsanstze der Komplexitt des Themas nicht gerecht werden. Die Prfung der Verfassungsmigkeit der Verstndigungspraxis ergibt, dass diese gegen eine ganze Reihe von Verfassungsgrundstzen verstt und auch die Gesetzesreform diese Verste allenfalls abmildern, aber nicht vermeiden kann. Dasselbe Ergebnis ergibt die Prfung der Vereinbarkeit mit dem geltenden Strafprozessrecht. Der Verfasser arbeitet zudem heraus, dass die Verfahrensbeteiligten sich bei der Durchfhrung von Verstndigungen, in der blichen Form und keinesfalls nur in Ausnahmefllen, strafbar machen und kommt zu dem Schluss, dass die Gesetzesreform nicht geeignet ist, dem Problemkomplex der Verstndigung im Strafverfahren zu begegnen. Weiterhin werden Regelungsvorschlge der Literatur diskutiert, mit dem Ergebnis, dass keiner der bisher verffentlichten Vorschlge zur Lsung aller relevanten Aspekte des Themas geeignet ist. Den Abschluss der Arbeit bildet dementsprechend ein eigener Lsungsvorschlag in Form von Leitlinien fr einen Gesetzentwurf.About the AuthorLars Hildebrandt wurde 1982 in Hamburg geboren und studierte von 2001 bis 2006 Rechtswissenschaften an der Universitt Hamburg. Anschlieend absolvierte er ebenfalls in Hamburg sein Rechtsreferendariat von 2008 bis 2010.
