Bei genauer Betrachtung ergeben sich dennoch zahlreiche Situationen, in denen die Ausbung dieses Rechts, dessen Rechtsnatur im Folgenden errtert wird, nicht unmittelbar vom Betroffenen selbst ausgebt wird, etwa weil er dazu aufgrund seines Alters oder seiner mangelnden Handlungsfhigkeit nicht in der Lage ist. Derartige Situationen ergeben sich regelmig im Zuge von Heilbehandlungen und rztlichen Eingriffen an minderjhrigen oder unmndigen erwachsenen Personen, allen voran dann, wenn die Erteilung einer Zustimmung zum Eingriff vom Patienten nicht erwartet werden kann. Im Hinblick auf solche Flle ist es notwendig, die Mglichkeiten einer gesetzlichen Vertretungsbefugnis sowie deren Umfang auszuloten und damit zu errtern, wer diese ausben darf und muss und welche Wirkungen die vom gesetzlichen Vertreter abgegebene Willenserklrung entfaltet, aber auch welche Manahmen das Gesetz zum Schutz des Betroffenen vorsieht. Schlielich sind die Grenzen der gesetzlichen Vertretungsbefugnis abzustecken.
