Die vorliegende Arbeit wurde von der Juristischen Fakultat der Universitat Heidelberg im Sommersemester 1989 als Habilitationsschrift angenommen. Nach Jahresbeginn 1989 erschienene Literatur hat noch in den FuBnoten Berucksichtigung gefunden. Mein besonderer Dank gilt meinem hochverehrten akademischen Leh rer, Herrn Prof. Dr. Karl Doehring, des sen Forderung und Rat wichtige WeichensteHungen mitbestimmt haben.
