Die strafrechtliche Erfassung von Graffiti stt nach geltendem Recht auf dogmatische Schwierigkeiten. Dies gilt vor allem fr die kritisch gewrdigten Flle mittelbarer Substanzverletzungen durch Wiederherstellungsschden. Grundlegende strafrechtliche Prinzipien und rechtsvergleichende Aspekte stehen der Bejahung der Zweckmigkeit einer Gesetzesnderung zur effektiveren Erfassung der Graffitikriminalitt nicht entgegen. Unter Diskussion aktueller Gesetzgebungsvorschlge wird am Ende ein Vorschlag zur mglichen Ausgestaltung der 303, 303 c, 304 StGB formuliert. About the Author Der Autor: Ingmar Wolf wurde 1977 in Ulm geboren. Von 1997 bis 2003 absolvierte er das Studium der Rechtswissenschaften an der Universitt Augsburg sowie am University College London. Seit 2003 ist der Autor Rechtsreferendar in Augsburg. Die Promotion erfolgte 2004.
