Gegenstand der Untersuchung ist die Frage, inwieweit horizontale Haftungsstrukturen im GmbHKonzern existieren. Der Themenbereich der horizontalen Konzernhaftung hat, mit wenigen Ausnahmen, in der Rechtswissenschaft und der Rechtsprechung bisher nicht die notwendige Aufmerksamkeit gefunden, obwohl sich gerade bei der Konzernstrukturierung immer wieder die Frage nach einer mglichen Haftung einer Schwestergesellschaft fr die Verbindlichkeiten einer anderen Schwestergesellschaft im Konzern stellt. Der Autor untersucht zunchst mgliche dogmatische Grundlagen, welche als Ansatz fr die Statuierung einer horizontalen Haftung dienen knnen, um nachfolgend zu berprfen, ob die gewonnenen Erkenntnisse auch dann anwendbar sind, wenn vertikale und horizontale Konzernstrukturen aufeinandertreffen.
